Die österreichische Umweltschutzorganisation Global 2000 hat Rechtsmittel gegen die vom Bundesamt für Ernährungssicherheit (BAES) gewährten „Notfallzulassungen“ dreier EU-weit verbotener Neonicotinoide zum Anbau von Zuckerrüben eingelegt.
Seit Tagen liegen bei der Behörde „Bescheidbeschwerden“ vor, in denen dargelegt wird, dass die erteilten Notfallzulassungen gegen die EU-Pestizidverordnung (EG) Nr.1107/2009 verstoßen.
Unterstützt wird die Argumentation von Global 2000 durch ein schwedisches Gerichtsurteil, sowie durch Dokumente der deutschen Zulassungsbehörde BVL, die der Umweltschutzorganisation vorliegen.
Global 2000 kämpft für die Bienen
„GLOBAL 2000 kämpft jetzt auch mit Rechtsmitteln für die Bienen, denn die österreichische Notfallzulassung ist eine missbräuchliche Umgehung des europäischen Pestizidverbots“, erklärt Helmut Burtscher-Schaden, Umweltchemiker bei GLOBAL 2000: „Es macht keinen Sinn, ein Verbot für gefährliche Pestizide zu erlassen, um diese nur wenige Monate später wieder zuzulassen. Diese Zulassung ist rechtlich nicht gedeckt.“
Burtscher-Schaden weist darauf hin, dass die Europäische Behörde für Lebensmittelsicherheit die Risiken für Honigbienen, Wildbienen und andere bestäubende Insekten als „unannehmbar“ bezeichnete.
Eine Klärung der Rechtmäßigkeit der Behördenentscheidung ist im öffentlichen Interesse und dringend notwendig. Global 2000 appelliert mit Nachdruck an das BAES und die Ministerin, die Beschwerden umgehend an das Bundesverwaltungsgericht weiterzuleiten, mit dem Ersuchen um Behandlung vor Ablauf der Bescheidfrist.
Keine Notfallzulassungen in Frankreich, Großbritannien, Deutschland und Schweden
Anträge auf Notfallzulassungen von neonicotinoiden Saatgutbeizmitteln für die Zuckerrübe wurden auch in Frankreich, Großbritannien und Deutschland gestellt, sind aber abgelehnt worden. Die schwedische Zulassungsbehörde KEMI hingegen hatte die Anträge schwedischer Rübenbauern ursprünglich positiv beschieden. Nachdem eine schwedische Umweltorganisation Zugang zu diesen Bescheiden erhielt und diese anfocht, hob ein schwedisches Gericht diese Zulassungsentscheidungen der Behörde auf.
„In Österreich wird das Neonicotinoid-Verbot jedoch per „Notfallzulassung“ ausgehebelt. Somit können bienengefährliche Saatgutbeizmittel auf geschätzten 40.000 Hektar Rübenfläche erneut zur Anwendung kommen.
GLOBAL 2000 wird weiter für den Schutz der Bienen kämpfen und alles daran setzen, dass die Rechtmäßigkeit der Notfallzulassung durch ein unabhängiges Gericht geklärt wird“, so Burtscher-Schaden abschließend.
